Terms and Conditions
The Lessee agrees to the following:
1. NO OTHER AGREEMENT: Except as otherwise mutually agreed in writing. This document is the complete agreement of the parties and supersedes all other agreements or understandings, written or oral.
2. INDEMNIFICATION: Lessee agrees that the equipment and all persons operating such equipment, including Lessor’s employees, and under Lessee’s exclusive jurisdiction, supervision, and control agrees to indemnify and save Lessor, its employees and agents harmless from all claims for death or injury to persons, including Lessor’s employees, from all loss, damage, or injury to property, including the equipment arising in any manner out of Lessee’s operation. Lessee’s duty to indemnify hereunder shall include all costs or expenses arising out of all claims specified herein, including all court and/or arbitration cost of settlement. Lessee shall not be required to indemnify Lessor for its sole negligence, but, Lessor’s liability for damage caused by the sole negligence of Lessor, its agents and employees, hereunder shall be limited to the amount of Lessor’s liability insurance.
3. RENTAL FEE: Pay agreed rental fee for container plus agreed amount for every day over ten (10) days.
4. WEIGHT LIMITS: Lessee will abide by manufacturer’s weight limits and Company weight limits. Lessee will pay all costs arising when exceeding such limits.
5. CONFORMANCE TO ALL LAWS: Lessee agrees to use the equipment in strict compliance with all applicable rules, laws, regulations, and orders.
6. DELIVERIES AND PICK UPS: It is the responsibility of the Lessee to make sure there is clear access to area where equipment is to be dropped and picked up. Any cost occurring from delays by obstructions or refusal causing rescheduling to the construction site will be borne by the Lessee.
7. TERMS OF PAYMENT:
A. If Charge-Full payment for all charges is due upon billing.
B. If C.O.D Full payment for initial charges is due prior to dropping equipment. Any additional charges are payable upon billing.
8. PROPERTY DAMAGE: The Lessee relieves the Lessor of all damages that might occur to driveways, sidewalks, wires, trees, and lawns while dropping or picking up containers or trailers. The Lessee also assumes all responsibility for damages when requesting a driver to drop a container or trailer too close to a building.
